AIG reports steeper 3Q net loss

(AP) ? Insurer AIG has posted a steeper third-quarter loss as declining interest rates and weak stock markets reduced the value of its holdings while it paid out storm losses.

American International Group Inc. reported on Thursday a loss of $4.1 billion, or $2.16 per share, compared with a loss of $2.52 billion, or $18.53 per share a year ago.

The operating loss was $3.04 billion, or $1.60 per share, up from a loss of $114 million, or 84 cents a year ago.

Analysts surveyed by FactSet expected a loss of 22 cents per share.

The company has been paying back the billions of dollars the U.S. government provided in the 2008 bailout and now owes roughly $68 billion.

Lindsay Lohan returns to court, may return to jail (AP)

LOS ANGELES ? Lindsay Lohan returns to court Wednesday to learn whether a judge will agree with a prosecutor advocating that the actress be returned to jail for failing to complete a community service assignment at a women's shelter.

Superior Court Judge Stephanie Sautner revoked Lohan's probation at a hearing nearly two weeks ago, but now must formally determine whether Lohan violated the terms of her sentence. The judge has asked prosecutors to calculate how long of a jail term the actress would have to serve if she is formally found in violation of her probation for misdemeanor drunken driving and theft cases.

Sautner, who is the fifth judge that Lohan has faced since her first arrest in 2007, has expressed exasperation with the actress and California's budget-strapped jail system.

"If jail meant something in the state of California now, maybe I'd put her in jail," Sautner said at Lohan's last court appearance.

The Los Angeles City Attorney's Office is advocating jail time for the actress, however spokesman Frank Mateljan declined to say Tuesday what sentence a prosecutor would seek.

Lohan's spokesman, Steve Honig, declined comment before the hearing.

The "Mean Girls" star has been reporting to the Los Angeles morgue regularly, which Sautner ordered her to do at the last court appearance. The judge had sentenced Lohan to serve 120 hours doing janitorial work at coroner's office in April, but expressed hope that the actress would benefit from working three times that amount of hours at a women's shelter.

Lohan, 25, was terminated from the shelter program after failing to show up nine times at the center. She told her probation officer the assignment was not fulfilling, according to the actress' probation report.

The actress' morgue service has not been without drama ? she was turned away the first day after showing up 40 minutes late. She has shown up early several times since then. Assistant Chief Coroner Ed Winter declined to characterize how Lohan's service was progressing Tuesday.

There are few, if any, untried punishment options if Sautner determines Lohan violated her orders. The former Disney star has been sent to jail, rehab, counseling and community service numerous times since being arrested twice for drunken driving in 2007. Her probation on that case is nearly over, but her release remains supervised after Lohan in May pleaded no contest to misdemeanor theft for taking a $2,500 necklace without permission in January.

Once a headlining actress, Lohan's court and personal troubles have overshadowed her career for years.

ABQJournal Online ? Freedom Communications Sells TV Stations

Freedom Communications Inc., the parent company of three New Mexico newspapers, has agreed to sell its television division to Maryland-based Sinclair Broadcast Group Inc. in a $385 million deal that will leave the company and its newspapers free of debt, the Clovis News Journal reported.

The company owns about 100 daily and weekly newspapers nationwide, including the Orange County (Calif.) Register, The Gazette in Colorado Springs and the Odessa (Texas) American, as well as three papers in New Mexico ? the Clovis News Journal, the Portales News-Tribune and the Quay County Sun.

The sale of Freedom?s eight television stations ? none of which is in New Mexico ? is expected to close in four to six months, subject to Freedom?s shareholder, Federal Communications Commission and antitrust approval, the company announced today.

Freedom CEO Mitchell Stern said the television sale will eliminate the company?s debt so management can concentrate on its newspapers, magazines and specialty publications, the News Journal said.

Freedom emerged from bankruptcy in April 2010 with $325 million in debt, some of which has been paid down in the past 18 months, the paper reported.

The company purchased its first television station, KTVL/10, a CBS affiliate in Medford, Ore., in 1981, and expanded its broadcast division to include five CBS network affiliates, two ABC affiliates and one CW Television Network affiliate, the News Journal said.

Embryonic signal drives pancreatic cancer and offers a way to kill it

Pancreatic cancer is a particularly challenging one to beat; it has a tendency to spread and harbors cancer stem cells that stubbornly resist conventional approaches to therapy. Now, researchers reporting in the November issue of Cell Stem Cell, a Cell Press publication, have evidence to suggest there is a way to kill off those cancer stem cells. The target is a self-renewal pathway known for its role not in cancer but in embryonic stem cells.

"I don't think the cancer stem cells have any direct link to embryonic development, rather they are using this developmental pathway for their uncontrolled self-renewal capacity," said Christopher Heeschen of the Spanish National Cancer Research Centre in Madrid. "This pathway is completely inactive in adult tissue. We've checked many tissues and there is zero ? no detectable expression at all."

The so-called Nodal/Activin pathway's embryonic ties and absence from other tissues present a real opportunity. It suggests you could target the molecular pathway without harming other adult cells. Heeschen's team has now shown that approach to therapy does seem to work in mice.

They first demonstrated the important role of the Nodal/Activin pathway in cancer stem cells derived from human pancreatic cancer. When that signal was blocked, normally resistant pancreatic cancer stem cells became sensitive to chemotherapy.

The researchers then moved on to experiments in mice with established tumors seeded from human cancer cells. Treatment of those animals with the pathway inhibitor plus standard chemotherapy eliminated those stem cells.

"The dual combination therapy worked strikingly well," Heeschen said. "The mice responded with 100 percent survival after 100 days." That's compared to mice not receiving the therapy, which bore large tumors and died within 40 days of implantation.

That two-part treatment wasn't enough to tackle pancreatic cancer when intact tumor tissue was implanted into mice as opposed to just cancer cells, the researchers found. Heeschen says that's because those cells were nestled within a supportive "stroma." That protective tissue delivered the Activin signal and prevented the drug combination from reaching the cells.

To get around that, Heeschen and his colleagues added a third ingredient to therapy, an inhibitor intended to target the stroma. The three-pronged approach translated into long-term, progression-free survival for the mice.

Interestingly, Heeschen says the animals' tumors didn't show signs of shrinking even as they were defeated. "They were more or less dead tissue. They were senescent with no cancer stem cells ? just sitting there," he said.

Those tissues apparently had no ability to form new tumors. The findings suggest that tumor regression isn't always the key thing to look for. It also shows that drugs designed to target cancer stem cells alone are promising, but only in combination with other drugs.

"The concept that you can hit cancer stem cells and tumors will melt away must be abandoned," Heeschen said. "You have to treat the entire cancer - the stroma, cancer stem cells and differentiated cells - as a complex. "

Heeschen says there are hints that this embryonic pathway might have important roles in other forms of cancer, including breast, lung and colorectal cancers. That's something they will now test in further studies.

NBA asks NY judge to clear obstacle in talks (AP)

NEW YORK ? Is the NBA lockout legal or not under antitrust laws?

That's the question league attorneys want a federal judge to answer ? before players potentially file an antitrust lawsuit as the NFL Players Association did during football's recent lockout.

U.S. District Judge Paul Gardephe, however, expressed reluctance Wednesday to wade into the NBA's labor mess.

In oral arguments in Manhattan, NBA attorney Jeffrey Mishkin said the NBA Player's Association is using the possibility of an antitrust fight like "a loaded gun" on the negotiating table and urged Gardephe to reject the union's request to toss the league's lawsuit.

Mishkin said the NBA is seeking the court's blessing for its actions so that the union stops threatening an antitrust fight to gain an upper hand in negotiations.

"They prefer the uncertainty," Mishkin said of the union's effort to get the lawsuit tossed out. "It's like taking a loaded gun and laying it on the table."

Gardephe brushed aside Mishkin's argument, saying posturing is part of negotiations.

"If they've put the gun on the table, it's not clear there are any bullets in it," the judge said. "The courts discount threats of litigation in the context of collective bargaining."

The NBA locked out its players July 1, and Commissioner David Stern already has canceled all November games.

Progress has stalled since talks broke off last Friday over the revenue split. The union's executive committee plans to meet Thursday in New York, a person with knowledge of the plans told The Associated Press. The person requested anonymity because the plans have not been made public.

Player's Association president Derek Fisher and executive director Billy Hunter each sent a letter to members earlier this week denying reports about a rift among the leadership.

Union lawyer Jeffrey Kessler said in court Wednesday that the NBA case should be tossed out because the league was trying to get the court involved on the mere possibility there would be an antitrust fight.

"They have no case," he said. "They're seeking to do something unprecedented, inappropriate."

Mishkin insisted the league had to act to stop threats that were hampering negotiations. He said the union was prepared to dissolve itself, a necessary legal step before individual players could bring antitrust actions against the league in federal court.

"They've already collected the cards. They can do it at any moment," he said. "We don't have to wait. We don't have to be subject to their whim.

"We want to get the antitrust threat out of the bargaining."

Gardephe did not immediately rule, but he questioned Mishkin at length and was skeptical of his arguments, saying at one point that the NBA lawsuit contained a "fair amount of speculation."

The judge indicated that for all the talk of tangling, the two sides were speaking different languages. Gardephe said reading the written briefs prior to the hearing was like watching "two ships passing in the night."

Jawbone found in England is from the earliest known modern human in northwestern Europe

ScienceDaily (Nov. 2, 2011) ? A piece of jawbone excavated from a prehistoric cave in England is the earliest evidence for modern humans in Europe, according to an international team of scientists. The bone first was believed to be about 35,000 years old, but the new research study shows it to be significantly older -- between 41,000 and 44,000 years old, according to the findings that will be published in the journal Nature. The new dating of the bone is expected to help scientists pin down how quickly the modern humans spread across Europe during the last Ice Age. It also helps confirm the much-debated theory that early humans coexisted with Neanderthals.

Beth Shapiro, the Shaffer Associate Professor of Biology at Penn State University and a member of the research team, explained that the fragment of maxilla -- the upper jaw -- containing three teeth was unearthed in 1927 in a prehistoric limestone cave called Kent's Cavern in southwestern England. Records from the original excavations, undertaken by the Torquay Natural History Society located in Devon, England, indicate that the jawbone was discovered 10 feet 6 inches beneath the surface and was sealed by stalagmite deposits. "In 1989, scientists at Oxford University dated the bone as being about 35,000 years old. However, doubts were later raised about the reliability of the date because traces of modern glue, which was used to conserve the bone after discovery, were found on the surface," Shapiro said. "We knew we were going to have to do additional testing to re-date the bone." Because the remaining uncontaminated area of bone was deemed too small to re-date, the research team searched through the excavation archives and collections in the Torquay Museum to obtain samples of other animal bones from recorded depths both above and below the spot where the maxilla was found.

Members of the research team then obtained radiocarbon dates for the bones of wolf, deer, cave bear, and woolly rhinoceros, all of which were found close to the maxilla, and all of which could be dated at between 50,000 and 26,000 years old. Using a Bayesian statistical-modelling method, the scientists then were able to calculate an age for the maxilla. The new date indicates that the bone is between 41,000 and 44,000 years old.

Tom Higham, Deputy Director of Oxford University's Radiocarbon Accelerator Unit and a member of the research team, said "Radiocarbon dating of ancient bones is very difficult to do. Because the initial date from this fragment of jawbone was affected by traces of modern glue, the initial measurement made in 1989 was too young. The new dating evidence we have obtained allows us, for the first time, to pinpoint the real age of this key specimen. We believe this piece of jawbone is the earliest direct evidence we have of modern humans in northwestern Europe."

Shapiro explained that the new and more-accurate date is especially important because it provides clearer evidence about the coexistence of Neanderthals and anatomically modern humans. "If the jawbone is, in fact, 41,000 to 44,000 years old, that means it was from a time when Neanderthals were still present in Europe, so we first had to confirm that the bone was from an anatomically modern human, and not a Neanderthal," Shapiro said. Shapiro and her team first tried to extract mitochondrial DNA from one of the teeth, but there were insufficient amounts for valid DNA sequencing. Eventually, team members were able to use a virtual three-dimensional model based on a CT scan of the jawbone to carry out a detailed analysis of the fossil. They compared the external and internal shapes of the teeth with those of modern human and Neanderthal fossils from a number of different sites. They found early modern human characteristics in all but three of the 16 dental characteristics.

Studies of the maxilla have been under way for the last decade, but it was only with the application of the latest investigative and dating techniques that the research team was able to make this breakthrough in identifying the jawbone as the earliest modern human so far known from Europe.

"Comparative data were lacking for some of the traits our team was studying," Shapiro said. "So, thankfully, our team member Tim Compton of the Natural History Museum in England helped by building a completely new database to help discriminate modern features from Neanderthal features. While the dominant characteristics are certainly modern, there are some that are ambiguous, or that fall into the Neanderthal range." The research team believe that these ambiguous features may reflect inadequate sampling of modern human variation, shared primitive features between early modern humans and Neanderthals, or even interbreeding between the two species. "We'll have to delve a little deeper and do more work to resolve these questions," Shapiro said.

Another exciting feature of the new study is that it could help solve the apparent discrepancy about the known dates of the Aurignacian period -- a time of cultural development in Europe and southwest Asia that lasted from around 45,000 to 35,000 years ago. Previous researchers have discovered artefacts and tools from this period that are thought to have been produced by the earliest modern humans in Europe. However, strangely, these artifacts have been found to be much older than the rare skeletal remains found in the same vicinity. While Aurignacian tools and ornaments have been dated at as old as 44,000 years, tests to pinpoint the age of relevant human remains have resulted in dates that reach no further than between 41,000 and 39,000 years ago, indicating a significant gap.

"The new date and identification of this bone from Kent's Cavern is very important, as we now have direct evidence that modern humans were in northwest Europe about 42,500 years ago," Higham said. "It confirms the presence of modern humans at the time of the earliest Aurignacian culture, and tells us a great deal about the dispersal speed of our species across Europe during the last Ice Age. It also means that early humans coexisted with Neanderthals in this part of the world, something that a number of researchers have doubted."

In addition to Shapiro, Higham, and Compton, other members of the research team include Chris Stringer, Roger Jacobi, and Chris Collins of the Natural History Museum in the United Kingdom; Erik Trinkaus of Washington University in the United States; Barry Chandler of the Torquay Museum in the United Kingdom; Flora Gr?ning, Paul O'Higgins, and Michael Fagan of the University of Hull in the United Kingdom; Simon Hillson of University College London in the United Kingdom; and Charles FitzGerald of McMaster University in Canada.

The research was funded by two organizations in the United Kingdom: the Leverhulme Trust, established at the wish of William Hesketh Lever, the first Viscount Leverhulme, and the Natural Environment Research Council.

Wisconsin bishops seek to keep guns out of church (Reuters)

MILWAUKEE (Reuters)- Wisconsin Catholic bishops are asking parishioners to avoid carrying guns into church, now that a new law permitting residents of the state to carry concealed weapons has gone into effect.

"Intuitively, we understand that acts of violence, destruction, and murder are antithetical to the message and person of Jesus Christ and have no rightful place in our society, especially sacred places," the bishops said in a statement on Monday on the eve of the law's Tuesday enactment.

"Whatever an individual parish decides to do regarding its policy on concealed weapons, we ask that all people seriously consider not carrying weapons into church buildings as a sign of reverence for these sacred spaces."

The statement was jointly issued by Milwaukee Archbishop Jerome Listecki and four other bishops from Madison, La Crosse, Green Bay and Superior. The bishops said a decision on whether to ban concealed weapons was up to individual churches.

The Wisconsin law leaves Illinois as the only state that does not allow residents to carry concealed firearms.

On the first morning of Wisconsin's concealed carry law, more than 80,000 application forms were downloaded from the Wisconsin Department of Justice website, spokeswoman Dana Brueck said.

The state expects to start issuing concealed carry permits later on Tuesday, although it will take applicants several days to receive them.

Under the new law, an employer may prohibit an employee from carrying concealed weapons at work, but cannot prohibit an employee from keeping concealed weapons in the employee's vehicle, even if it is parked on employer property.

The law mandates four hours of instructor-led training to carry a concealed weapon, or completion of a hunter safety course through the Wisconsin Department of Natural Resources.

Those who would be allowed to carry such weapons must be at least be 21 years old, a Wisconsin resident and not prohibited from possessing a firearm under state or federal law, or as a condition of bail or release in a criminal case.

Permitted under the new concealed weapons law are handguns, electric weapons such as stun guns or tasers, knives other than switchblades, and billy clubs. Machine guns, short-barreled rifles and short-barreled shotguns are prohibited.

When carrying concealed, Wisconsin residents must also carry a license and photo ID unless on their own property. Out-of-state residents from the 26 states with requirements similar to Wisconsin's can legally carry a gun with an out-of-state carry permit. However, Wisconsin residents must have a state-issued permit.
