Self-Defense Immunity Laws: Which States ... - Legal Insurrection

Now that the Zimmerman criminal trial has concluded, much attention has focused on the prospects for Zimmerman seeking protection under Florida?s self-defense immunity statute from any possible civil action against him.

Florida?s statute 776.032, is among the broader self-defense immunity statutes, in that it possesses all four qualities of an optimal statute of this type.

First, it is not limited to particular settings or circumstances (e.g., such as to self-defense encounters in and around one?s home).

Second, it prohibits even the arrest of the person who acted in self-defense, in the absence of probable cause for such arrest.

Third, it immunizes against criminal as well as civil liability.

And, fourth, it provides for the defendant who successfully obtains immunity to recover all reasonable legal expenses (and, in the case of Florida, even compensation for lost income) from the plaintiff.

Fully 32 states provide some degree of limitation of liability for the individual who has genuinely acted in self-defense, but there is considerable variety in terms of the scope and manner of protection provided.

Property-centered Immunity

Five states provide self-defense immunity only in the context of a defense of dwelling. Conceptually, this is very similar to the Castle Doctrine, in which you are relieved of any generalized duty to retreat if you are defending yourself in your home. These states include Colorado, Georgia, Hawai?i, Maryland, Ohio, and Wisconsin.

No Arrest In Absence of Probable Cause

Three states provide that the person who acted in claimed self-defense may not even be arrested unless their exists probably cause to believe that their use of force was not legitimate self-defense. As a practical matter, the use of deadly force in self-defense routinely results in the arrest of the person who used that force. Typically the person who used the force either clams up when confronted by investigating officers, or they admit to the use of force but claim it was done in self-defense. All this in the context of a ?victim? who is either complaining bitterly about a gun having been pointed at him, or perhaps bleeding out in the street.

Under these circumstances the officers usually conclude that there is at least probable cause that there exists reasonable evidence in support of a potential crime having been committed, and an arrest is made. Whether the act was done in self-defense is, from the officer?s perspective, to be determined by others further down the criminal justice ?pipeline?. The five states that prohibit arrest unless there is probably cause that the use of force was not done in legitimate self defense?Alabama, Florida, Kansas, ?Kentucky, and Oklahoma?essentially require that the police look at both sides of the question?both the use of force as a potential crime and the justification of self-defense.

Immunity Protection from Both Criminal and Civil Liability

Ten states provide immunity protection against criminal prosecution as well as civil law suits. These include: Alabama, Colorado, Florida, Kansas, Kentucky, Missouri, North Carolina, Oklahoma, South Carolina, and Washington. Note, however, that where a state limits the scope of its self-defense immunity statute generally?as Colorado limits its statute to use of force around one?s home?this limitation applies in the context of both criminal and civil liability.

Recovery of Attorneys Fees, Trial Expenses If Sued Anyway

If a person who used force in self-defense is nevertheless sued, and they successfully argue their claim to self-defense immunity at trial, the party suing them is subject to having to pay the defender?s attorney?s fees and other legal expenses. This rule applies in sixteen states, including Alaska, Florida, Idaho, Kentucky, Louisiana, Maryland, Michigan, Missouri, Montana, New Hampshire, North Dakota, Oklahoma, Pennsylvania, South Carolina, ?Tennessee, and Washington.

In fifteen of those states the statute provides that the court ?shall? award such expenses where the defendant has successfully argued self-defense immunity. This gratifyingly takes the reimbursement of these expenses out of the hands of the trial court?s discretion. In Maryland, however, the statute only provides that the court ?may? order the reimbursement of such expenses.

Odd Twists

I did come across a couple of odd twists in looking at the various states? self-defense immunity statutes, and thought I share a couple with you.

First, Delaware appears to provide for immunity for the use of force in protection of property, but not for the use of force in self-defense. Indeed, the statute specifically references defense of another person?s property. My sense is that this statute was actually written to protect persons such as armed guards against civil liability for their use of force against robbers. Perhaps a lawyer from Delaware could provide greater context.

Second, New Jersey?s self-defense immunity law is written specific within the context of the use of a ?chemical substance in self-defense? . . . and that?s it. So, if you use pepper spray or mace or something equivalent in legitimate self-defense, you seem to fall under the protection of the statute. Any other means of self-defense, whether deadly or non-deadly, would seem to place you outside that umbrella of protection.

Thursday's Little League roundup: Two York baseball teams endure rough day at state

It was a diffficult Thursday for two teams from York County in their respective Little League baseball state tournaments.

In the age 9-10 first round in Richmond, York County American dropped its opener 14-4 to Broadway of the Shenandoah Valley. ...

In the age 10-11 first round, McLean American routed York County National 23-0 in four innings, scoring 10 runs in the top of the first.

Byron Evans and Jake Brewer had York National?s hits.

News summary: Safeway 2nd-qtr results beat Street

THE NEWS: Profit at grocery store chain Safeway Inc. fell in the second quarter, partly on a tax charge related to a deal to sell its Canadian operations. But adjusted results topped Wall Street expectations.

CONTEXT: Safeway and other traditional supermarket chains have been working to focus operations and keep costs low to fight off competition from big-box discounters, along with drug stores and dollar stores that have expanded grocery sections.

ADJUSTED VIEW: Safeway now expects net income, excluding one-time items, to be at the lower end of its previously expected range of $2.25 to $2.45 per share. Analysts expect $2.27 per share.

Transport Canada mum on rail safety rules

Transport Canada won?t say what the minimum requirements are for making sure a parked train won?t roll away and it won?t disclose the rules set by the rail companies for keeping unattended trains with potentially dangerous goods stationary.

The CBC asked Transport Canada to clarify the rules for tying down a train a few days after the Lac Megantic tragedy. More than two days later, the response ignored the specific request for minimum requirements and referred to the Canadian Rail Operating Rules.

The guidelines in the CROR, however, lack specificity on parking trains.

Section 112, on "Securing Equipment", says: "When equipment is left at any point a sufficient number of hand brakes must be applied to prevent it from moving. Special instructions will indicate the minimum hand brake requirements for all locations where equipment is left."

The section goes on to discuss parking a train on a siding, and to specify that hand brakes need to be fully tested before they can be used to secure equipment.

Eight days after the initial request, Transport Canada continues to rebuff CBC's inquiries with vague answers.

"The rules provide specific instructions for the use of hand brakes to prevent the train from moving when equipment is not in use," it said in an email to CBC.

"Each railway has instructions that further specify how many handbrakes are applied. These instructions also govern special circumstances such as a grade. The handbrake requirements are not load specific. Requirements are determined by the amount of cars, terrain, etc."

NDP MP Olivia Chow said that's not good enough.

"Canadians need to know that the trains coming through their neighbourhoods are safe," Chow said on Thursday.

That's why the Conservatives should not hide the operations of these trains, said Chow, vice chair of the House of Commons transport committee.

"If there's nothing to hide, come clean. Tell Canadians what the operations are and whether they are safe or not."

Lac-M?gantic

In the early morning of July 6 a Montreal, Maine and Atlantic train, which included five engines, a boxcar and 72 cars of crude oil, left its parking spot in Nantes, Que., near the Maine border, and rumbled downhill into Lac-M?gantic. The crude oil cars separated from the engines and boxcar, and two explosions and a fire engulfed the town of 6,000.

Rescue officials have recovered 42 bodies and at least eight people are still believed missing.

The causes of the explosions are still a mystery, but what has consumed rail experts is what precautions did MMA locomotive engineer Tom Harding take to secure the train. Did he comply with MMA's own internal special instructions for that stretch of rail? Did the MMA guidelines meet the requirements of Transport Canada?

The company originally said after the accident that Harding had put on the air brakes and left the engine running when he jumped in a taxi to go to a hotel for the night. It also said that Harding applied the appropriate number of hand brakes. Last Wednesday, MMA chairman Ed Burkhardt confused the debate by saying Harding "told us he applied 11 hand brakes and our general feeling is that now, that is not true."

That the CROR allows individual companies to set their own special instructions creates confusion, says Ian Naish, a consultant with 27 years in transportation safety.

"The rules that are applied by Transport Canada, Rule 112, says that sufficient number of hand brakes must be applied when you are stopping a train and leaving it for a bit," explained Naish. "Well how do you define that? Various railways have defined it different ways for various types of grades, or types of trains.

"The way the regulatory system has operated for the last 20 to 25 years is, basically, the railways are responsible to regulate themselves, and the federal government is the overseer, the watcher of the way they operate."

Canadian Pacific, which has traditionally had the strictest rules on securing trains because of the risks of having steeper lines through the Canadian Rockies, sent out new general operating instructions to its employees last week in anticipation of stricter Transport Canada rules.

On Thursday morning, new Transport Minister Lisa Raitt said if there are going to be any new rules coming from Transport Canada, "I'll be the one announcing them. As for Canadian Pacific, I'm very pleased to see they're taking a look at theirs and I spoke to CN this week and they?re doing the same."

Company rules on 'braking, securement' kept secret

The Montreal, Maine and Atlantic, CN and CP have refused to share their special instructions with the CBC, calling them proprietary, and Transport Canada said they can?t release it because "this type of information is not in the public domain, as it involves a third-party."

But an investigator with the Transportation Safety Board, which has looked at a long list of runaway trains, derailments and crashes, told the CBC that the rules are "vague and unclear."

The investigator, who spoke on condition of anonymity, cited the 13 CN coal cars that slid downhill last year in Hanlon, Alta., crashing into a parked train.

The TSB concluded the rules were unclear, CN's standards were inadequate and the staff had problems calculating just how many cars need to be locked down by hand.

Chow argues that Transport Canada has ignored too many recommendations, not only from the Transportation Safety Board but also a scathing report by the Auditor General in 2011 which says alarm bells were raised in 2005 about transporting dangerous goods.

"Transport Canada said it would take a year or two to implement the auditor general's recommendations, but these are not new problems," said Chow.

"It's been eight years that they had no comprehensive list of what's being transported, what's the performance standard and what's the quality assurance program" for transporting dangerous goods.

"That?s not acceptable."

The answer, says Chow, is not a public inquiry, but transparency and strong government.

"Without transparency we don't know who is accountable," she told CBC Thursday. "Why do we need a government if they don't regulate?"
